Boise man charged with malicious harassment after threatening victim based on "national origin"

A Boise man has been arrested for felony malicious harassment after Boise Police say he threatened a victim based on their “national origin.”

BPD was initially contacted on Monday, June 13th at 10:20 p.m. after a reported threatening incident on W. Taft Street and N. Silver.

Police determined that a suspect, determined to be Brian Pottinger, drove by a victim and made threatening comments toward the victim on multiple occasions.

Pottinger was arrested and charged with malicious harassment which is defined by Idaho Code as, “It shall be unlawful for any person, maliciously and with the specific intent to intimidate or harass another person because of that person's race, color, religion, ancestry, or national origin, to:

(a)  Cause physical injury to another person; or

(b)  Damage, destroy, or deface any real or personal property of another person; or

(c)  Threaten, by word or act, to do the acts prohibited if there is reasonable cause to believe that any of the acts described in subsections (a) and (b) of this section will occur.
